DACA Update: December 8, 2020

DACA is back! NMILC will begin screening low-income, first-time applicants for the Deferred Action for Childhood Arrivals (DACA) program following the public notice published by the Department of Homeland Security (DHS) fully restoring the program to its pre-2017 form. This comes after a New York federal judge ruled the Trump administration to fully restore DACA last friday. The four main changes in effect as of December 7, 2020, are as follows:

  1. U.S. Citizenship and Immigration Services (USCIS) must begin to accept initial DACA applications.

  2. USCIS must begin to process advance parole requests once again.

  3. USCIS must extend any one-year permit issued back to the regular two-year period.

  4. USCIS must continue to process DACA renewals for the original two-year period. 


After the Supreme Court ruling that restored the program this past summer, between June and July, 122 individuals without DACA status signed up for our services. Unfortunately, their cases were left in limbo after USCIS released a memo excluding first-time applicants from eligibility for the program. Our team is excited to once again begin helping first-time, low income, eligible candidates fill out their initial DACA application, while continuing to assist current recipients with permit renewals. First-time applicants who meet the eligibility criteria should:

  2. Fill out the form and send it back to NMILC.

  3. A representative will follow-up to schedule a consultation with one of our attorneys.

DACA renewal procedures will remain the same, those looking to renew should call 505-247-1023 to schedule an appointment with one of our representatives. Eligible candidates will receive a call to schedule remote assistance. 

This is a victory for thousands of undocumented youth who have been living a limbo filled with uncertainty since the Trump administration rescinded the program in 2017 and thousands of others waiting to apply for the first time. We expect to see an influx of first time applicants in the coming weeks and months and we need your help!
